As US Supreme Court opens, all eyes on Chief Justice John Roberts

The US Supreme Court opens its 2012-2013 term Monday with Justice Anthony Kennedy again the likely swing vote. But given his vote on the Affordable Care Act, Chief Justice John Roberts may not be predictably conservative either.

By Warren Richey,?Staff writer / September 30, 2012

Workers cover the U.S. Supreme Court building in Washington with a protective scrim, as work continues on the facade. The Supreme Court is embarking on a new term beginning Monday that could be as consequential as the last one with the prospect for major rulings about affirmative action, gay marriage, and voting rights.

The US Supreme Court begins its 2012-2013 term on Monday with a blunt question: Which version of Chief Justice John Roberts will show up at the high court this year?

Will it be the hard-charging conservative who struck down election-season speech restrictions on corporations in the 2010 Citizens United decision, and who invalidated racial preferences in public schools in Seattle and Louisville in 2007?

Or will it be the circumspect judicial minimalist who guided the high court away from overturning a major provision of the Voting Rights Act in a 2009 Texas case, and who last June voted with the court?s liberal wing to prevent the election-year invalidation of President Obama?s health care reform law?

The chief justice is expected to have ample opportunity in the new term to become reacquainted with his conservative colleagues in potential blockbuster cases involving affirmative action, voting rights, and gay marriage.

The question is, will he?

How much do you know about the US Constitution? A quiz.

Legal analysts suggest Chief Justice Roberts has earned a degree of good will from would-be liberal critics in the wake of his surprising vote to uphold the health care law. Some scholars praised the chief justice?s acrobatic decision as a modern-day version of Marbury v. Madison.

Conservatives scoff at such suggestions. They say Roberts appears to have caved in to bullying and threats from President Obama and others who launched what they say was a sustained campaign of intimidation once it looked like the court was poised to overturn the health care mandate.

?Whatever explanation [exists] is not legitimate because we all agree that it is not a good thing for justices ? chief justices ? or judges to act politically, to try to split the differences, to try to balance competing imperatives,? Washington Lawyer David Rivkin said during a recent panel discussion at the libertarian Cato Institute.

Mr. Rivkin, who served as a lawyer challenging the health care law, said a similar ?campaign of intimidation? would likely arise in future high-stakes cases.

The court?s docket suggests it may not be a long wait.

On October 10, the Supreme Court is set to examine the constitutionality of racial preferences in college admissions at the University of Texas.

In addition, the high court is expected to soon consider whether to take up appeals involving California?s Proposition-8 ban on same-sex marriages and whether the Defense of Marriage Acts? prohibition on same-sex spouses collecting federal benefits violates the Constitution?s guarantee of equal treatment.

Stephen Robert Wycoff killed in police-involved shooting in California, Md.

September 29, 2012 - 10:14 am

A California, Maryland man was shot and killed by a deputy following a violent struggle with police.

Just before 2 a.m. Saturday, deputies from the St. Mary's County Sheriff's Office were called to the 23000 block of Sugar Maple Court in California, Maryland for a report of a disturbance.?

Cpl. Cindy Allen, with the sheriff's office, says deputies were confronted by 39-year-old Stephen Robert Wycoff at the scene. Corporal Michael George, a nine year veteran on the force, fired at Allen, striking him.

Wycoff died at the scene while George was taken to the hospital, treated and released. George has been placed on administrative leave, which is routine.

An investigation into the shooting continues.

The Best Way To Apply For A Student Loan | Free Finance Articles

The coed loan application process is not as difficult as it sounds. While it can be done through a bank or credit union, it's better to do it right from the academic establishment. Once the application for admission is accepted, the following step is at the financial aid office. The staff know the most direct and simplest techniques of securing funds. When the help request is sent straight from the college, the letterhead guarantees the swiftest reply.

Once an individual has an acknowledgment letter, the financial help office can offer a catalogue of numerous sources to pay for the education. Before entering this office, be sure to have the maximum amount of the background documentation with you. These include your tax estimates for the year before as well as those of your parents. A parent or guardians earnings is usually considered unless the coed is married or has been living separately for a period surpassing 12 months.

3 primary factors will decide the trail decided upon for securing funds. These are; student?s status, monetary needs , and grade point from school. The student?s status refers to full or part time. The course of study also comes into action due to special fees connected with certain scholastic paths like lab or equipment needs.

A prospective scholars highschool grade point will help define the student?s suitability for grants and scholarship awards. The monetary desires will consider the potential student as well as mummies and daddies and/or spousal earnings too.

For any form of financial support, ensure enough time is allowed for a response. Most institutions suggest at least an eight-week lead-time, however it could be a shorter time then that.. The earlier one applies, the better the chances of securing the obligatory funds in time to start class at the beginning of the semester.

Romney: Obama is 'trying to fool' voters with inaccurate attacks

DENVER - Mitt Romney today accused President Obama of "trying to fool" voters into thinking Romney believes in things he does not, telling reporters aboard his campaign plane that Obama is running on talking points he knows are "wrong."

"The president will not be able to continue to mischaracterize my pathway," said Romney, in answering a question about the importance of the upcoming debates. "I'll continue to describe mine, he will describe his, and people will make a choice. That's the great thing about democracy.

"I'm not going to try to fool people into thinking he believes things he doesn't," Romney said. "He's trying to fool people into thinking that I think things that I don't. And that ends at the debates."

Romney's press conference came after a rough week for the candidate, and is the first sign of an attempt by the candidate to turn around the campaign, which is set to make stops in the battleground states of Colorado, Ohio and Virginia before the week's end.

Asked by ABC News which issues he specifically thinks the President is trying to "fool" voters about or which particularly get to him, Romney rattled off a list: the auto maker bailout, taxes and social issues.

"They're not that they particularly get to me, but I think that they're inaccurate," said Romney.

Romney said "nothing could be further from the truth" when Obama says he supported liquidating the auto industry.

"My plan was to rebuild the auto industry and take it through bankruptcy so that could happen, and by the way he doesn't mention he took them through bankruptcy," Romney said.

Romney said Obama accuses him of being in favor of lowering taxes on wealthy people.

"No I'm not," Romney said. "I'm not going to reduce the taxes on the wealthy at all, in fact I want to lower taxes on middle income people. He says I want to raise them on middle income people - that's completely inaccurate."

And on abortion, Obama's wrong on that, too, Romney said.

"He says I'm opposed to abortion even in cases of rape and incest," Romney said. "That's wrong.

"One ad after another of his ad statements has been determined to be factually inaccurate," Romney said. "And you know I understand that politics is politics but in the past, when you've had an ad which has been roundly pointed out to be wrong you take it out and you correct it and put something back on. He keeps running these things even though he knows they're wrong and saying them in rallies, even though he knows they're wrong."

When asked if he doesn't think it's vital for him to "win" the first debate, which is just over a week away, Romney declined to get into the stakes of the debates.

"I don't expect this to be a contest of who can say the cutest phrase, I think it's a contest of very different directions for the country," he answered.

The Obama campaign in a statement following Romney's remarks said that it's "odd" Romney "won't take personal responsibility for his campaign's troubles," adding that it takes "a lot of chutzpah" to "shed crocodile tears over a legitimate discussion of his record and policies."

"Here are the facts: if Mitt Romney had had his way and we'd let Detroit go bankrupt, GM and Chrysler would no longer be in business today. He would raise taxes on middle class families to pay for tax breaks for millionaires and billionaires," said Obama campaign spokeswoman Lis Smith. "And he endorsed the Republican Party platform that would ban abortion even in the cases of rape and incest. If he's so offended by his own positions, maybe he shouldn't have taken them in the first place."

arthurt's Site - Bring back your creativity | Self Improvement Tips ...

You need a 7 Day BrainwashI must be honest. There are some days when I sit down to write and I think there?s not a shred of creativity in me. Today, as I began, was one of those days.

So I thought, why don?t I tell them about that? How do you get creative or resourceful when it just doesn?t seem to be there?

Easy peasy, as we used to say at school. (I think we might have added ?lemon squeezy? too ? but who cares?).

I simply remember all the times I have been resourceful. I see myself sitting at my desk writing furiously, wondering how on earth so much time can have passed I?m on such a roll. I recall times when I was teaching, or explaining something passionately to my kids, or when I had to think up a plausible excuse to get myself out of a hole, or when friends dropped in unexpectedly and I concocted a meal out of a larder I had considered empty ?. the number of times any one of us has been creative and resourceful is huge.

Pretty soon, my brain is so full of ideas, I wonder if I can just keep to one a day. My posture changes, I may walk about, my breathing is different.

And you know what? You can do it the other way round too. If I change my posture, my breathing and my movements to the way I am when I feel creative, that old creative feeling comes back all by itself.

Look Up! International Observe the Moon Night Rises Tonight

The moon will take center stage for stargazers in the around the world tonight (Sept. 22) during International Observe the Moon Night to share the beauty of Earth's nearest neighbor with the public.

Many moon-watching events are planned around the world tonight, with NASA and Canadian astronomers aren't missing out. NASA's Ames Research Center in Moffett Field, Calif., and Western University in Ontario, Canada, will hold special events to share methods on how to observe the moon with the public, as well as interesting moon facts and history. ?

Tonight, the moon will appear half-full in what is known as the first quarter moon, making it a prime target for amateur astronomers and casual night sky observers.

"The first quarter moon rises around 2:25 p.m. and sets around 12:15 a.m." explained SPACE.com contributor Geoff Gaherty, an astronomer with Starry Night Software, which offers computer guides to the night sky. "It dominates the evening sky."

The full moon of September, which is also known as a Harvest Moon, will rise on Sept. 29.

At the Ames Research Center, astronomers with NASA's Lunar Science Institute will hold five 15-minute discussions and presentations on the moon at Shenandoah Plaza, while visiting amateur astronomers and astronomy clubs will set up telescopes for public viewing. The event runs from 8 p.m. to 11 p.m. PDT.

"Through International Observe the Moon Night, we hope to instill in the public a sense of wonderment and curiosity about our moon," Ames center officials said in an announcement. [Amazing Blue Moon Photos for 2012]

You can learn more about how to participate in Ames' event here: http://lunarscience.nasa.gov/inomn/

At Western University, meanwhile, scientists with the school's Center for Planetary Science and Exploration will convene at the Hume Cronyn Memorial Observatory from 6 p.m. to 10 p.m. local time to discuss moon observation, lunar science and other moon-oriented subjects.

"In addition to observing the Moon with Western's Perkin-Elmer refracting telescope (weather permitting), astronomers and planetary scientists will deliver talks, present lunar meteorites and lead a cell phone photo contest," Western University officials said in a statement.

More information on the Western University's event is here: http://cpsx.uwo.ca/outreach/event-news/inomn-2

The NASA Ames and Western University events are just two of countless public moon-watching programs scheduled around the world for the International Observe the Moon Night, which is now in its third year.

This year's event comes just weeks after the death of Neil Armstrong, the first person ever to walk on the moon. Armstrong, who commanded NASA's Apollo 11 moon landing mission, died on Aug. 25 at age 82 due to complications from recent heart surgery. He was buried at sea on Sept. 14.

To honor Armstrong's memory, his family has asked that the public take time to think of the pioneering astronaut when gazing at the moon.

"?Honor his example of service, accomplishment and modesty, and the next time you walk outside on a clear night and see the moon smiling down at you, think of Neil Armstrong and give him a wink," they said in a statement.

International Observe the Moon Night officials have set up a public Flickr webpage where amateur astronomers can post their "winks" at the moon for Armstrong here: http://www.flickr.com/groups/inomn2012/

For a complete list of International Observe the Moon Night webcasts and events, or to find an event near you, visit: http://observethemoonnight.org/

Florida State/Clemson Overflow

And was he not pretty damn good? He surprised us Noles. He played an excellent game and if FSU continues to win (cause that?s how the Heisman works) he?ll be considered. I disagree with a lot said here about your D regarding effort. Early on they were stuffing us with excellent effort,a gambling scheme and Venable?s smoke and mirrors.

Your offense was flawless in the first half and very impressive. Watkine, Hopkins and Andr? are elite,as good as you?ll find anywher. I think a lot of Boyd too after watching him this year. You were thrashing a really good team for 3 quarters, but, yes, you?ve got some serious deficiencies against the run, Favor you guys next year at CU given what we lose and you keep.

I accept Process...as long as it yields immediate beneficial results.
